Terms of Service

Spot is operated by White Whale Portal, based in the United Arab Emirates (“we,” “us,” “our”). By using Spot (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

1. Description of Service

Spot is a game and personal collection tool. It lets you photograph vehicles you find in the real world, turns them into collectible cards, assigns each a rarity score and tier, and displays them in your personal Garage and on a map. The App provides identifications and scores for entertainment and informational purposes only. It does not guarantee the accuracy of any vehicle identification, score, or rarity assessment.

Spot is free to download and use. The free tier lets you card up to three catches per calendar day; everything you have already collected stays yours to browse without limit. An optional paid subscription, Spot Pro, is described in Section 2.

2. Spot Pro Subscriptions

What it unlocks. Spot Pro removes the three-a-day limit on new catches and unlocks premium card finishes and mythic foils, advanced rarity insights, and the additional accent themes. It does not change how cars are identified or scored, and it does not buy a better score.

Plans and price. Spot Pro is an auto-renewing subscription offered in two lengths: weekly and yearly. At the time of writing these are US$2.49 per week and US$23.99 per year; prices vary by country and may change over time. The price shown on the purchase screen in your own currency, before you confirm, is the price that applies to you.

Free trial. Both plans currently include a one-week free trial for subscribers who have not used a trial or introductory offer in the Spot Pro subscription group before. Eligibility is determined by Apple. If you subscribe while a free trial is running, any unused part of that trial is forfeited.

Payment and renewal. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period, and your Apple Account is charged for the renewal within the 24 hours before that period ends.

Cancelling. You can manage or cancel your subscription at any time in your Apple Account settings. Cancelling stops the next renewal; it does not end the period you have already paid for, and your Pro features stay on until that period runs out. Deleting the App does not cancel a subscription.

Apple is the seller. All purchases are made through Apple’s In-App Purchase system. We never receive your card details, and no payment information passes through our servers. Because Spot has no user accounts, your subscription is attached to your Apple Account and can be restored on another device signed in to the same Apple Account using “Restore” on the subscription screen. Spot Pro is not currently offered through Family Sharing.

Refunds. We cannot issue refunds for App Store purchases, because we do not take the payment. Refund requests go to Apple at reportaproblem.apple.com and are decided by Apple under its own policies. Nothing in this section limits any statutory right of withdrawal, refund, or remedy you have as a consumer under the law of your own country.

Changes to Spot Pro. We may add, change, or withdraw Pro features as the App develops, and we may change prices. A price increase applies to an existing subscription only in the way the App Store’s own rules allow, which in the cases those rules specify requires your agreement before it takes effect. If we discontinue Spot Pro altogether, we will stop renewals and you will keep access until the end of the period you have paid for.

3. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. In particular:

You are solely responsible for how and where you use the App and for complying with all applicable local laws, including laws about photographing people and private property.

4. Your Content and the Promises You Make

License to us. When you submit a photo, you grant us a limited, non-exclusive license to process, store, and display that photo within the App and its services for the purposes described in the Privacy Policy (including sending the blurred image to our third-party recognition provider).

Your warranties. You represent and warrant that: (a) the photo is one you personally took; (b) you took it lawfully and in a public place; (c) it does not infringe the rights of any person; and (d) you have not used images taken from the internet, other apps, screens, or third parties.

Your ownership. The photos you take remain your own property. These Terms do not transfer ownership of your photos to us.

5. AI-Generated Identifications and Scores

Spot uses artificial intelligence to identify vehicles and generate rarity scores. These outputs may be inaccurate, incomplete, or contextually wrong. You are responsible for reviewing and, where offered, correcting them. Spot does not provide legal, financial, mechanical, or professional advice of any kind.

6. Rarity Scores Are for Entertainment — Not Valuations

The “Spot” score, rarity tier, and any related figures are estimates generated for entertainment purposes only. They are not appraisals, valuations, or statements of fact about any vehicle’s worth, specifications, condition, or authenticity. You must not rely on them for any financial, purchase, sale, or insurance decision.

7. No Affiliation with Manufacturers

Spot is an independent product. It is not affiliated with, endorsed by, sponsored by, or licensed by any vehicle manufacturer, tuner, or brand. All manufacturer names, model names, and marks belong to their respective owners and are used only descriptively to identify vehicles. The App does not use manufacturer logos, badges, brand fonts, or trade dress.

8. Data Handling

When you catch a car, the App blurs plates, faces, and IDs on your device on a best-effort basis, then transmits the processed image to a third-party AI provider solely to identify the vehicle. Your collection, map, and history are stored locally on your device. Please review our Privacy Policy for full details of what data is processed and how.

9. Data Deletion

You may delete individual catches at any time in the App. Because your collection, map, and history are stored only on your device, deleting the App removes all locally stored data permanently. This cannot be undone.

Deleting the App does not cancel a Spot Pro subscription. Billing runs through your Apple Account, so it keeps renewing until you cancel it there (Section 2).

10. Intellectual Property

All rights, title, and interest in the App — including its software, design, card artwork, rarity system, and branding — remain our property. You may not copy, distribute, modify, decompile, or reverse engineer any part of the App. As stated above, the photos you take remain your own property.

11. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use the App, including but not limited to inaccurate vehicle identifications or scores, failure of the automatic blur to remove personal information, or any consequences of photographing people, vehicles, or property. The App is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not warrant that the automatic blur will remove every plate, face, or ID number, and we do not warrant that the App or any Pro feature will be uninterrupted or error-free.

Where liability cannot lawfully be excluded, our total liability to you for all claims taken together is limited to the amount you paid for Spot Pro in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited under the law that applies to you \u{2014} including the statutory rights of consumers, which these Terms do not affect.

12. Indemnification

You agree to indemnify, defend, and hold harmless White Whale Portal from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: your use of the App; photos you submit (including any claim that a photo was not yours, was taken unlawfully, or infringed another person’s rights); your violation of these Terms; or your violation of any third-party rights.

13. Age Requirement

Spot is not intended for use by anyone under the age of 16. By using the App, you confirm that you meet the applicable minimum age requirement. In any region where a higher age of digital consent applies, that higher age governs.

14. Termination

We may suspend or terminate your access to the App if you violate these Terms or misuse the service, including by faking catches or abusing the anti-cheat systems. You may stop using the App at any time. Upon termination, your locally stored data remains on your device until you delete it.

Terminating your access does not by itself cancel a Spot Pro subscription, because we do not control your Apple Account billing — you must cancel it yourself in your Apple Account settings, and you should do so to avoid a further renewal. If we terminate your access other than for a breach of these Terms, you may request a refund of the unused part of your current period from Apple.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict-of-law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates. Before formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at contact@spotcards.app. If it is unresolved within 30 days, either party may pursue formal proceedings under the governing law.

16. Severability, Force Majeure & Entire Agreement

Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be modified to the minimum extent necessary to make it valid.

Force majeure. We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, or third-party service outages.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and communications, whether written or oral.

17. Changes to These Terms

We may update these Terms from time to time. The date at the top indicates the most recent revision. For material changes, we will make reasonable efforts to notify you through the App. Continued use after changes are posted constitutes acceptance of the revised Terms.
